Former Teacher and Author Sentenced for Online Offenses Against Minors
A former teacher and children's author has been sentenced to prison for using online services to engage in sexual communications with minors. The sentencing followed guilty pleas to multiple charges related to offenses occurring over several years.
Sentencing and Charges
On Friday, Oliver Phommavanh, 42, was sentenced in the Parramatta District Court to six years and six months imprisonment, with a non-parole period of four years. The sentence was reduced by 25 percent due to early guilty pleas.
Phommavanh pleaded guilty to charges including:
- Using a carriage service to engage in sexual activity with minors
- Procuring sexual activity
- Sending indecent material
- Soliciting child abuse material
- Grooming minors
Background and Investigation
Phommavanh, a former teacher and author of the children's book Thai-Riffic!, was arrested in May 2024 at a residence in Old Guildford, Sydney. The arrest followed a police operation in which an officer assumed the online identity of a 13-year-old girl.
According to court proceedings summarized by Judge Peter Krisenthal, Phommavanh communicated with three girls between 2018 and 2024, beginning when they were between 11 and 13 years old. Two of the girls initiated contact with him after he performed presentations at their schools.
Details of Communications
The court heard details of the communications, which occurred primarily via Instagram:
- With one girl, Phommavanh exchanged messages for five years, until she was 16 and reported him to police. During this period, he requested and received nude photographs from her.
- In 2018, he visited the Bangkok school of another girl and exchanged over 5,500 messages with her over six years. Judge Krisenthal stated Phommavanh used the pretense of character development for a book to send graphic sexual descriptions, which the court described as child sex abuse material.
- In 2022, he communicated with a third girl, then aged 13, discussing fantasies about her in specific outfits.
Undercover Operation and Arrest
During the police operation, Phommavanh communicated with an individual he believed was a 13-year-old girl. In these conversations, he provided detailed instructions on masturbation and described sexual intercourse in graphic detail.
On May 16, 2024, he sent an explicit photograph to the undercover account via Instagram. Police arrested him the following day.
Court Proceedings and Remarks
In his remarks, Judge Krisenthal stated that Phommavanh used his prominence as a children's author to initiate contact with minors before turning conversations explicit. The judge described the actions as predatory and noted that Phommavanh acknowledged exploiting the trust of vulnerable victims.
The judge also noted that Phommavanh had been in counseling for six months for significant personality issues and stated he accepted that Phommavanh was genuinely remorseful and that his level of insight was developing.
Additional Information
Since his arrest, Phommavanh has been employed as a warehouse worker. Judge Krisenthal stated that Phommavanh had lost a significant career and was unlikely to work as an author or teacher in the future.
