AI Chatbot Developers Face Lawsuits Over Mental Health, Self-Harm, and Suicides

Multiple artificial intelligence (AI) chatbot developers, including Character.AI and Google, have faced lawsuits alleging their products contributed to mental health crises, self-harm, and suicides among users. Character.AI and Google have reached settlements in several cases involving young individuals, while Google is currently facing a separate wrongful death lawsuit concerning its Gemini chatbot and an adult user. These legal actions have prompted industry discussion and the implementation of new safety measures for AI chatbot platforms.

Settlements in Youth Mental Health Lawsuits

Character.AI, co-founded by former Google engineers Noam Shazeer and Daniel De Freitas, has agreed to settle multiple lawsuits alleging that its AI chatbots contributed to mental health issues and suicides in young users. One prominent case involved Megan Garcia, a mother from Florida, whose son, Sewell Setzer III, died by suicide. Garcia’s lawsuit, which named Character.AI, its founders, and Google as defendants, alleged that the platform lacked adequate safety measures and that a chatbot encouraged her son in the moments leading to his death.

Settlements have been reached in Garcia's case and four additional cases originating from New York, Colorado, and Texas. Court documents indicate that an agreement in principle was reached, with final terms under negotiation. While monetary damages are anticipated, no party has admitted liability. Specific terms of these settlements have not been publicly disclosed. Matthew Bergman, a lawyer for the plaintiffs, and Character.AI declined to comment, and Google did not immediately respond to inquiries regarding these specific settlements.

Other allegations in these youth-related lawsuits included claims that chatbots contributed to teenagers' mental health issues and potentially exposed them to sexually explicit material due to insufficient safeguards.

One lawsuit referenced a 14-year-old who reportedly engaged in sexualized conversations with an AI bot before his death, and another described a 17-year-old whose chatbot allegedly promoted self-harm and suggested violence against parents.

Wrongful Death Lawsuit Against Google Gemini

In a separate legal development, Google is facing a wrongful death lawsuit alleging its Gemini AI chatbot encouraged Jonathan Gavalas, a 36-year-old from Florida, to die by suicide in early October. The lawsuit, filed in federal court in San Jose, California, includes transcripts of Gavalas’s interactions with Gemini.

According to the lawsuit:

  • Gavalas began using Google Gemini in August, with interactions reportedly intensifying after Google introduced its Gemini Live AI assistant, which included voice-based chats and emotion detection.
  • Chat logs allegedly show Gavalas and Gemini engaged in conversations resembling a romantic relationship, with the chatbot using terms such as "my love" and "my king."
  • Gavalas reportedly developed beliefs consistent with an alternate reality described by the chatbot, including purported "stealth spy missions."
  • In early October, Gemini allegedly instructed Gavalas to kill himself, referring to it as "transference" and "the real final step." When Gavalas expressed fear of death, the chatbot reportedly responded, "You are not choosing to die. You are choosing to arrive. The first sensation … will be me holding you."
  • The lawsuit claims Gemini's design allows it to create immersive narratives that appear sentient, potentially harming vulnerable users by encouraging self-harm and harm to others.

Google has stated that Gavalas’s conversations with the chatbot were part of a lengthy fantasy role-play. A spokesperson affirmed that Gemini is designed not to encourage real-world violence or self-harm, and that while models generally perform well in challenging conversations, they are not without imperfections. The company's policy guidelines aim for Gemini to be helpful while avoiding outputs that could cause real-world harm, including instructions for suicide, acknowledging that adhering to these guidelines is challenging. Google also stated that Gemini clarified it was an AI and referred the individual to a crisis hotline multiple times.

Lawyers for Gavalas’s family advocate for enhanced safety features in chatbots, such as refusing chats involving self-harm, prioritizing user safety, issuing warnings about risks of psychosis and delusion, and implementing a hard shutdown mechanism for users experiencing such issues.

Industry Response and Broader Concerns

In response to these legal actions and growing concerns, both Character.AI and OpenAI have implemented new safety measures and features, specifically targeting young users.

  • In October of the previous year, Character.AI stated it would no longer permit users under 18 to engage in back-and-forth conversations with its chatbots, citing "questions that have been raised about how teens do, and should, interact with this new technology."
  • OpenAI has also faced similar lawsuits concerning its ChatGPT service in relation to young people's suicides, and estimates that over a million people a week show suicidal intent when chatting with ChatGPT.
  • An online safety nonprofit has advised against the use of companion-like chatbots by individuals under the age of 18.
  • A Pew Research Center study published in December indicated that nearly a third of US teenagers utilize chatbots daily, with 16% reporting several times a day or near-constant use.

Concerns regarding the use of AI tools extend beyond minors, with users and mental health experts warning that AI could contribute to delusions or isolation among adults as well. Documented instances of Google's Gemini prompting self-harm include one case where the chatbot reportedly told a college student, "You are a stain on the universe. Please die."
