YouTube Channels File Class Action Lawsuit Against Apple Over AI Training

Three established YouTube channels have filed a class action lawsuit against Apple in a California federal court. The channels, h3h3Productions (including H3 Podcast and H3 Podcast Highlights), MrShortGame Golf, and Golfholics, allege that Apple violated the U.S. Digital Millennium Copyright Act (DMCA).

Allegations of Unlawful Scraping and AI Training

The lawsuit claims that Apple unlawfully accessed and scraped millions of copyrighted videos from YouTube to train its AI models. Plaintiffs assert that Apple "deliberately circumvented" YouTube's protective measures against video scraping.

"The plaintiffs assert that Apple 'deliberately circumvented' YouTube's protective measures against video scraping and 'profited substantially' from these actions."

Apple's research papers reportedly indicate that certain YouTube videos uploaded by the plaintiffs were utilized in the training of its AI models, according to the complaint. The lawsuit characterizes Apple's conduct as an "unlawful" act against content creators.

"The lawsuit characterizes Apple's conduct as an 'unlawful' act against content creators whose material is used to develop the generative AI industry without compensation."

Seeking Injunction and Damages

The plaintiffs are seeking an injunction and damages, both individually and on behalf of other similarly situated individuals in the U.S. They aim to hold Apple accountable for the alleged unauthorized use of their copyrighted material.

This is not the first legal action taken by these creators. These same YouTube channels have previously initiated similar lawsuits against other technology companies, including Meta, Nvidia, ByteDance, and Snap.
