Man Sentenced for Manslaughter of Postmaster After Retrial

Troy Matthew Maskell, 47, has been sentenced to seven years and nine months in prison for the manslaughter of 73-year-old John Burke, a postmaster in Strathmerton, northern Victoria. The sentencing follows his second conviction by a Supreme Court jury after a successful appeal led to a retrial. Mr. Burke died in October 2021, two months after an incident at a service station.

Incident Details

The incident occurred in August 2021 at a service station. CCTV footage presented during court proceedings showed Mr. Maskell throwing a 1-litre bottle of sports drink at Mr. Burke's head and subsequently kicking him to the ground.

Mr. Burke was hospitalized following the incident and died two months later from a brain bleed and fractured pelvis.

Legal Proceedings and Sentencing

Mr. Maskell was initially found guilty of manslaughter, but a successful appeal resulted in a retrial. A Supreme Court jury recently found Mr. Maskell guilty of manslaughter for a second time.

Justice James Elliot sentenced Mr. Maskell to seven years and nine months in prison, imposing a non-parole period of four years and eight months. During the sentencing, Justice Elliot stated the court's intention to send a message that "unprovoked" and "gratuitous" violence "would not be tolerated."

Parole Eligibility and Background

Mr. Maskell has served 1,470 days in pre-sentence detention. He is scheduled to be eligible for parole in October of the current year.

The court heard information regarding Mr. Maskell's mental state, which reportedly deteriorated after his involvement in clean-up efforts following the Black Saturday bushfires and a cyclone in Queensland.

Victim Impact and Statements

Mr. Burke's sister, Suzanne Heppel, described her brother as a long-serving community member who had been the town's postmaster for 45 years.

Prosecutor Erin Ramsay characterized Mr. Maskell's actions as having devastated Mr. Burke's family and resulted in a "protracted death."
