FedEx Sues U.S. Government for Refund on "Illegal" Trump-Era Tariffs

Federal Express has initiated a lawsuit against the U.S. government, seeking a refund for tariffs previously implemented by President Donald Trump. This legal action follows a recent Supreme Court decision that determined these tariffs, imposed under the International Emergency Economic Powers Act (IEEPA), were illegal.

Lawsuit Details Emerge

FedEx, alongside its affiliated company FedEx Logistics, officially filed the lawsuit on Monday. The complaint specifically targets U.S. Customs and Border Protection (CBP), its commissioner Rodney Scott, and the U.S. government. The primary objective is for the companies to recover a full refund of all IEEPA duties they have paid.

This legal action is noteworthy as it appears to be the first lawsuit filed by a major American corporation seeking such refunds since the Supreme Court's pivotal decision. Other prominent companies, including Costco, also have ongoing lawsuits addressing similar claims at the U.S. Court of International Trade.

Tariff Background and Key Ruling

The tariffs in question were initially imposed by President Trump on various U.S. trading partners last year.

The Supreme Court recently ruled that the Court of International Trade possesses exclusive jurisdiction over IEEPA tariffs and explicitly declared them illegal.

Previously, in September, FedEx had projected a significant $1 billion impact on its fiscal year earnings due to U.S. trade policies, which encompassed these very IEEPA duties.

Company Position on Refunds

FedEx has stated on its website that it has acted to safeguard its rights as an importer of record to pursue duty refunds.

The company also noted that a specific refund process has not yet been established by regulators or the courts. FedEx has committed to providing updates as further developments emerge in this complex legal landscape.
