Ofelia Torres, Advocate in Father's Immigration Case, Dies After Cancer Battle

Ofelia Torres, the 16-year-old Chicago Public Schools student renowned for her advocacy in her father's immigration detention case, has died following a battle with a rare form of cancer. Her passing occurred days after an immigration judge granted her father, Ruben Torres Maldonado, a conditional pathway to lawful permanent residence.

Ofelia's Health Battle and Tragic Passing

Ofelia Giselle Torres Hidalgo, aged 16, passed away on Friday, November 29. She had been battling Stage 4 Alveolar Rhabdomyosarcoma, a rare and aggressive form of soft tissue cancer, since her diagnosis in December 2024. Ofelia was undergoing chemotherapy and radiation treatments at the time.

She is survived by her loving family: her mother, Sandibell Hidalgo; her father, Ruben Torres Maldonado; and her younger brother, Nathan.

Father's Arrest Sparks Daughter's Advocacy

Ruben Torres Maldonado, a painter and home renovator, was detained by federal immigration agents on October 18 at a Home Depot store in Niles, a Chicago suburb. This detention was part of a broader immigration enforcement operation. Notably, Ofelia had been discharged from Lurie Children’s Hospital the day prior to her father's arrest, on a temporary break from her cancer treatment.

Despite her severe illness, Ofelia publicly advocated for her father's release. She created a poignant video for a GoFundMe page, bravely stating:

"I find it so unfair that hardworking immigrant families are being targeted because they were not born here."
"Immigrants are humans with families and deserve to be treated with love and respect."

Ofelia's commitment to her father's case was evident when she attended a federal court hearing from a wheelchair. Attorneys representing Mr. Torres Maldonado argued for his immediate release, emphasizing the hardship his absence caused his U.S. citizen children, his lack of a criminal record, and his strong community ties.

Federal prosecutor Craig Oswald acknowledged the family's difficult situation but stated that the government decided against voluntary release, partly due to Mr. Torres Maldonado's alleged non-cooperation during his arrest. The Department of Homeland Security also alleged that Mr. Torres Maldonado, who entered the U.S. in 2003, had been living illegally in the U.S. for years and had a history of driving offenses, including driving without a valid license, without insurance, and speeding.

A federal judge subsequently ruled Mr. Torres Maldonado's arrest and detention illegal, citing a violation of his due process rights, and ordered a bond hearing. He was released on October 30 on a $2,000 bond.

Immigration Ruling Offers Hope Days Before Her Passing

Just three days before Ofelia's death, a significant development occurred: an immigration judge in Chicago ruled that Ruben Torres Maldonado was conditionally eligible for "cancellation of removal." This decision was based on the severe hardships his deportation would inflict upon his U.S. citizen children.

The ruling provides a crucial pathway for Mr. Torres Maldonado to achieve lawful permanent resident status and, potentially, U.S. citizenship. Ofelia was present for this pivotal news, witnessing the proceedings via Zoom.

Kalman Resnick, the family's attorney, issued a statement mourning Ofelia's passing, commending her unwavering advocacy during her father's detention.

Broader Impact and Personal Reflections

Beyond her direct involvement in her father's case, Ofelia Torres left a profound impression on educators and public officials. Her high school teacher connected her with Illinois state Representative Laura Faver Dias, with whom Ofelia discussed critical issues such as healthcare policy and concerns about Medicaid. Representative Dias then introduced Ofelia to state Representative Will Guzzardi, further extending her reach.

U.S. Representative Delia Ramirez acknowledged Ofelia as a true inspiration for her advocacy, and Chicago Mayor Brandon Johnson offered heartfelt condolences to the family.

In her personal life, Ofelia’s father reportedly emphasized the importance of independence, purchasing a car for her 15th birthday and encouraging activities such as boxing and karate.
